Who pays the capital gains tax when selling property in the Philippines?
The seller pays the capital gains tax — 6% of the higher of the selling price or the BIR zonal / fair-market value. It must be filed and paid to the BIR within 30 days of the sale.
Who pays the transfer tax and registration fees?
Customarily the buyer shoulders the documentary stamp tax (1.5%), the local transfer tax (0.5%–0.75%), the registration fee and the notarial fee. The seller pays the capital gains tax and the broker's commission. Every item is negotiable and should be written into the Deed of Absolute Sale.
How much does it cost to transfer a land title?
All-in, expect roughly 7%–9% of the property value once you combine the seller's 6% capital gains tax with the buyer's documentary stamp tax, transfer tax, registration and notarial fees (about 2.5%–3%). Use the calculator above for your exact figure.
Are the taxes based on the selling price or the zonal value?
